TREVO Subscriptions Terms and Conditions

Applicable to the TREVO Host Subscriptions and TREVO Guest Subscriptions

These TREVO Subscriptions Terms and Conditions (“Terms and Conditions”) are issued by Future Mobility Solutions Sdn Bhd [Registration No. 201901010667 (1319995-W)] (“TREVO”) and govern the subscriptions made available through the TREVO mobile application (“TREVO App”) (each, a “Subscription” and collectively, the “Subscriptions Programme”). By subscribing to, using or renewing a Subscription, the relevant TREVO member (“Member”) agrees to be bound by these Terms and Conditions together with the TREVO Terms of Service and any applicable product-specific terms disclosed through the TREVO App.

1. SCOPE AND INTERPRETATION

1.1. The Subscriptions Programme comprises: (a) the TREVO Host Subscriptions, under which eligible Hosts subscribe to specified GPS-related facilities and services for their vehicles; and (b) the TREVO Guest Subscriptions, under which eligible Guests may receive discount(s) on the Rental Fee for qualifying vehicle bookings. These two Subscriptions are separate products and may have different fees, eligibility criteria and benefits.

1.2. “Host” and “Guest” have the meanings given to them under TREVO Terms of Service.

1.3. “Subscription Benefits” means the applicable device, features, discounts or other benefits associated with a Subscription as described in these Terms and Conditions and the TREVO App.

1.4. “Rental Fee” means the vehicle rental fee to which a discount is expressly applied in the TREVO App, excluding any separate fees or charges unless expressly indicated otherwise in TREVO App.

1.5. Each Subscription shall be valid for thirty (30) days commencing on its activation date (“Subscription Period”) and shall automatically renew for successive thirty (30)-day Subscription Periods in accordance with Clause 5, unless TREVO App expressly specifies a different subscription period at the time of purchase.

1.6. The price, discount(s), eligible products or bookings, usage conditions and other commercial particulars displayed in TREVO App in connection with a Subscription form part of these Terms and Conditions for the relevant transaction. In respect of such particulars, the information displayed to the Member in TREVO App at the point of subscription or booking confirmation, as applicable, shall prevail over any earlier promotional material.

1.7. These Terms and Conditions shall be read together with TREVO Terms of Service at https://trevo.my/terms/ and TREVO Privacy Notice at https://trevo.my/privacy/. Except for matters specifically governed by these Terms and Conditions, the TREVO Terms of Service shall continue to apply, including to the relevant vehicle listings, rental bookings and use of the TREVO platform. Capitalised terms not defined herein shall have the meanings assigned under the TREVO Terms of Service.

2.1. A Subscription may be purchased by a Member with an active TREVO account who satisfies the relevant eligibility requirements indicated in the TREVO App. TREVO may verify eligibility and may decline a sign-up where the Member is not eligible or the account is suspended, restricted or otherwise in breach of applicable terms.

2.2. To subscribe, a Member must log in to the TREVO App, select the relevant subscription package through the subscription or pass section of the App, review the applicable fees and benefits, and complete payment in accordance with the instructions displayed in the App. The interface and subscription steps may be updated by TREVO from time to time.

2.3. The subscription fee payable for each Subscription shall be the prevailing fee displayed in the TREVO App at the relevant sign-up or renewal. Unless otherwise indicated in the TREVO App, the subscription fee is charged separately from amounts payable for vehicle rentals, related services or other transactions.

2.4. Where a Member holds more than one Subscription, each Subscription shall be separately activated, billed, renewed and cancelled, unless otherwise expressly stated in the TREVO App. Subscription Benefits are available only while the relevant Subscription remains active and the Member complies with these Terms and Conditions.

3. TREVO HOST SUBSCRIPTIONS

3.1. The Subscription is intended for eligible Hosts and provides a GPS device for the relevant vehicle, together with access to such GPS-related features, functions, services and/or benefits as TREVO may make available through the TREVO App from time to time.

3.2. Each Subscription applies to one (1) vehicle only and to the GPS device installed in, or assigned to, that vehicle. A separate Subscription is required for each additional vehicle for which the Host wishes to obtain the relevant Subscription Benefits, unless TREVO expressly provides otherwise.

3.3. The subscription fee for the Subscription shall be based on the prevailing subscription fee as displayed in the TREVO App from time to time, subject to any revisions communicated in accordance with Clause 5.5. The GPS device, its functionality and the available GPS-related Subscription Benefits shall remain subject to the applicable conditions, service limitations and technical requirements as may be determined and communicated by TREVO from time to time.

3.4. The Host shall provide such reasonable access, cooperation and necessary authority for installation, activation, inspection, maintenance or troubleshooting of the GPS device as may be required and communicated by TREVO or its authorised service providers. The Host shall not tamper with, disable, misuse, interfere with or permit unauthorised access to the GPS device or related systems.

3.5. Where a GPS device or GPS-related service malfunctions, fails or becomes unavailable, the Host shall promptly notify TREVO through its designated support channels. TREVO may investigate and, where appropriate, troubleshoot, repair, reset, replace or otherwise rectify the affected device or service, subject to the applicable arrangements and any rights or remedies prescribed by law.

3.6. GPS-related functionality may be affected by matters such as network or telecommunication availability, device compatibility, maintenance, system downtime and third-party service interruptions. TREVO does not guarantee uninterrupted GPS functionality, but this shall not exclude any obligation or liability that cannot lawfully be excluded.

4. TREVO GUEST SUBSCRIPTIONS

4.1. The Guest Subscriptions entitles an eligible Guest, during an active Subscription Period, to discount(s) on the Rental Fee of eligible bookings made through the TREVO App, subject to the applicable conditions displayed in the TREVO App.

4.2. The discount(s) applicable to the Guest Subscriptions shall be stated in the TREVO App from time to time. For the avoidance of doubt, the available discount(s) may vary according to season, promotional campaign, rental dates, vehicle category, availability or other criteria specified in the TREVO App.

4.3. For each eligible booking, the applicable discount(s) shall be the discount shown in the TREVO App at the time the Guest confirms that booking. The Guest shall review the discounted Rental Fee and total amount payable before confirmation. Any subsequent change in the advertised Guest Subscriptions discount shall apply prospectively and shall not, solely by reason of that change, alter the discount already applied to a confirmed booking.

4.4. Unless expressly stated otherwise in the TREVO App, the discount applies only to the eligible Rental Fee and not to any other amounts, including service or processing fees, protection or insurance-related charges, delivery fees, tolls, fuel, additional services, deposits, penalties or taxes. Any minimum spend, discount cap, eligible booking period, exclusion, redemption limit or other restriction shall be as specified in the TREVO App.

4.5. The Guest Subscriptions discount cannot be combined with any other voucher, promotion, discount or incentive unless the TREVO App expressly permits such combination. The discount cannot be exchanged for cash, transferred to another Member or retrospectively applied to a booking confirmed before the relevant Subscription became active.

4.6. The Guest Subscriptions does not guarantee the availability of any particular vehicle, Host or booking. All bookings remain subject to the TREVO Terms of Service, Host acceptance (where applicable), vehicle availability and other booking conditions in the TREVO App. Where a booking is modified or cancelled, the applicable discount and charges shall be recalculated or handled in accordance with the booking terms shown in the TREVO App.

4.7. Any Guest Subscriptions benefit not used during the relevant Subscription Period shall expire at the end of that Subscription Period and shall not be carried forward, converted into cash, extended or reinstated, unless TREVO expressly provides otherwise in the TREVO App.

5. AUTO-RENEWAL, PAYMENTS AND CANCELLATION

5.1. Unless cancelled by the Member before the next renewal date, each Subscription shall automatically renew for another Subscription Period at the prevailing subscription fee. By subscribing, the Member authorises TREVO and its payment service providers to charge the applicable fee to the Member’s registered or selected payment method for the initial and each renewal Subscription Period.

5.2. The renewal date, prevailing fee and applicable Subscription Benefits may be viewed through the TREVO App or such other channels as TREVO makes available. The Member is responsible for maintaining a valid payment method and reviewing subscription information before renewal.

5.3. A Member may cancel a Subscription at any time through the TREVO App or another cancellation channel designated by TREVO. Cancellation will take effect at the end of the then-current paid Subscription Period, unless otherwise stated in the TREVO App or required by law. The relevant Subscription Benefits shall ordinarily remain available until that time, provided the Subscription has not been suspended or terminated for breach.

5.4. If an initial or renewal payment cannot be successfully processed, TREVO may retry payment and/or suspend, restrict or terminate the affected Subscription and its Subscription Benefits until the applicable payment is completed. No Subscription Benefits shall accrue for any period in which the relevant Subscription is inactive or suspended.

5.5. TREVO may revise the subscription fee for either Subscription from time to time. Any revised fee shall be communicated through the TREVO App or another appropriate channel before it takes effect and, for an existing Subscriber, shall apply from a subsequent renewal rather than retrospectively to an already-paid Subscription Period. A Member who does not wish to accept the revised fee may cancel before the renewal at which the revised fee is to apply.

5.6. Subscription fees paid for an activated Subscription Period, including a renewed Subscription Period, are non-refundable merely because the Member cancels early or does not fully use the Subscription Benefits, except where a refund is required by applicable law or expressly provided under an applicable TREVO policy. Cancellation of a Subscription does not, of itself, cancel an existing vehicle booking or affect sums payable for that booking.

6. CHANGES TO BENEFITS AND PROGRAMME AVAILABILITY

6.1. TREVO may introduce, revise, replace, limit, suspend or discontinue any Subscription Benefit or eligibility requirement from time to time, including the GPS-related features under the GPS Subscriptions and the discount(s) or eligible bookings under the Guest Subscriptions. The then-applicable benefits and conditions shall be stated in the TREVO App and shall be subject to Clause 4.3 in respect of discounts already applied to confirmed bookings.

6.2. TREVO may suspend, withdraw or terminate a Subscription or the Monthly Subscriptions Programme for technical, operational, legal, security or commercial reasons. TREVO will give notice where reasonably practicable and where required by applicable law. Any refund, adjustment or other remedy arising from such action shall be determined in accordance with applicable law and the relevant circumstances.

7. MEMBER CONDUCT AND ENFORCEMENT

7.1. A Member shall use the Subscription and its Subscription Benefits only for lawful and authorised purposes and shall comply with these Terms and Conditions, the TREVO Terms of Service and all instructions reasonably issued by TREVO in connection with the relevant product or service.

7.2. Without limitation, a Member shall not: (a) obtain or attempt to obtain Subscription Benefits by fraud, manipulation, false information or misuse of multiple accounts; (b) interfere with, circumvent or compromise TREVO systems, the TREVO App, GPS devices or payment mechanisms; (c) access data, accounts, devices or software without authorisation; (d) transmit malicious code or otherwise disrupt the Programme; or (e) harass other Members or infringe the rights of TREVO or third parties.

7.3. Where TREVO reasonably determines that a Member has breached these Terms and Conditions or the TREVO Terms of Service, TREVO may reject an application, suspend or terminate the relevant Subscription, withhold improperly obtained Subscription Benefits, restrict access to the Programme or take other lawful action. This is without prejudice to any rights and remedies available to the Member under applicable law.

8. PERSONAL DATA

8.1. TREVO will collect, use, disclose and otherwise process personal data in connection with the Monthly Subscriptions Programme in accordance with its Privacy Notice at https://trevo.my/privacy/ and applicable data protection laws. Where necessary to provide GPS-related services, relevant device or location data may be processed in accordance with the Privacy Notice and any applicable notices or permissions.

9. LIABILITY

9.1. To the maximum extent permitted by applicable law, TREVO shall not be liable for indirect or consequential loss, loss of opportunity or loss of profits arising from the use or inability to use a Subscription or Subscription Benefit. TREVO shall not be liable for interruptions caused by events outside its reasonable control, except to the extent responsibility is imposed by applicable law.

9.2. Nothing in these Terms and Conditions excludes, limits or restricts any statutory right, remedy, obligation or liability that cannot lawfully be excluded, limited or restricted, including liability arising from fraud, wilful misconduct or any other matter for which exclusion is prohibited by law.

10. GENERAL PROVISIONS

10.1. TREVO may amend these Terms and Conditions from time to time. The updated version shall be made available through TREVO App or another appropriate channel, with notice of material changes where required by applicable law. A change to these Terms and Conditions shall not retrospectively change the applicable discount or subscription fee for a transaction or Subscription Period already confirmed and paid for, except as required by law or expressly agreed by the Member.

10.2. TREVO’s failure or delay in enforcing any provision shall not constitute a waiver of that provision. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force to the extent permitted by law.

10.3. The section headings are included for convenience and do not affect interpretation. Words in the singular include the plural and vice versa, where the context permits.

10.4. These Terms and Conditions are governed by the laws of Malaysia. For questions, complaints, cancellation assistance or technical support relating to a Subscription, the Member may contact TREVO through the support or contact channels made available in TREVO App.
